<p>(SAN FRANCISCO, CA &#8211; 07/10/12)  Today,  the Coalition for Safe San Francisco, along with dozens of other  community organizations, civil rights groups and professional bar  associations, sent a letter to Mayor Edwin Lee, expressing alarm and  opposition to his statements in support of implementing a  &#8220;stop-and-frisk&#8221; policy in San Francisco.  On June 27, Mayor Lee told  the San Francisco Chronicle&#8217;s editorial board that he is considering  implementing a &#8220;stop-and-frisk&#8221; policy to address gun violence in San  Francisco.</p>
<p>&nbsp;</p>
<p>Mayor Lee indicated that he had discussed the idea with New  York Mayor Michael Bloomberg. Aliya Karmali, of the National Lawyers  Guild San Francisco Bay Area Chapter, stated, &#8220;The National Lawyers  Guild and others were extremely surprised that Mayor Lee was looking to  New York City&#8217;s &#8216;stop-and-frisk&#8217; as a model practice for San Francisco,  when the New York City program has been thoroughly discredited and  criticized as discriminatory.&#8221; Karmali also noted that &#8220;less than a  month ago, on June 17, thousands of New Yorkers marched in the street to  protest this precise policy.&#8221;</p>
<p>&nbsp;</p>
<p>Nasrina Bargzie, Staff Attorney at the Asian Law Caucus stated,  &#8220;The Asian Law Caucus is alarmed by and adamantly opposed to policies  that in effect permit for racial profiling.  We call on Mayor Lee to  immediately retract his statements concerning possible implementation of  this policy in San Francisco.&#8221;</p>
<p>The Coalition&#8217;s letter  asserts that the proposed policy is ineffective and damaging to  communities already plagued by high rates of police misconduct and  incarceration.</p>
<p>&nbsp;</p>
<p>Zahra Billoo, Executive Director of CAIR-San Francisco Bay Area stated, &#8220;NYPD&#8217;s  own data on its &#8216;stop-and-frisk&#8217; policy reveals that it has resulted in  minimum weapons and/or contraband yield but has targeted communities of  color at disproportionate and alarming rates.&#8221; Biloo added that &#8220;in  2011, an analysis of the data shows that a record 685,724 people were  stopped.  Blacks and Latinos made up 84% of all those stopped, although  they make up respectively 23% and 29% of New York City&#8217;s total  population. Of African American males between the ages of 14 to 24, the  number of stops last year was greater than their total population.&#8221;</p>
<p>&nbsp;</p>
<p>The  Coalition of groups joins a growing chorus of opposition to the  prospect of implementing a &#8220;stop-and-frisk&#8221; policy in San Francisco that  includes SFPD Police Chief Greg Suhr and SF Public Defender Jeff  Adachi.<br />
The letter calls upon Mayor Lee to make an immediate public statement  to assure San Franciscans that he is no longer considering the adoption  of a &#8220;stop-and-frisk&#8221; policy in San Francisco  and that any steps he  takes to address gun violence will be implemented in a way that does not  rely on racial or other forms of profiling.</p>

<p>(SAN FRANCISCO, CA &#8211; 05/10/12) On Wednesday, May 9, 2012, Mayor Edwin Lee signed <a>the </a><a href="http://r20.rs6.net/tn.jsp?e=001EEc95yrxMB-oAkivtcdnNGGY80GkJfv-wQib2EZ3KmpE8ro4JqCGIMZO3jegBSVr7tJZUnpXQbaVTiSV-HSuDRv3tySfrPE0Hn3ruDUDkYPZp_Dzg8gTvxmPaK7DJqK37PuYvfXBqH5UCVrFZofjguX9BIiuy-dk6BujsksG5IO8nvuSj9Dhm-Tr49PgmvUHK0YbG0r9g3eKpNNW9UUvDQ==" target="_blank">Safe San Francisco Civil Rights Ordinance</a>.  The Ordinance was passed unanimously by the San Francisco Board of Supervisors on Tuesday, May 8. The   Mayor was joined by the Ordinance sponsor Supervisor Jane Kim, Board   President David Chiu, Supervisor Christina Olague, Police Chief Greg   Suhr, and members of the Coalition for a Safe San Francisco.</p>

<p>Mayor Lee spoke in support of the Ordinance, alongside community member Mokhtar Alkhanshali, Asian Law Caucus Executive Director Hyeon-Ju Rho, Arab Cultural &amp; Community Center President Fuad Ateyeh, and Asian Law Caucus and Coalition Coordinator Summer Hararah, and in the presence of over fifty community members.<br />

<p>The Ordinance requires:</p>

<ol>
<li>adherence to San Francisco and California local standards when the SFPD works with the FBI&#8217;s Joint Terrorism Task Force (JTTF)</li>
<li>that  before any new agreements are entered into between the SFPD and the FBI  regarding the JTTF work, that those agreements must be subject to  public review and comment before the Police Commission, and</li>
<li>yearly reports to the Police Commission of the SFPD&#8217;s work with the FBI JTTF.</li>

<p>&#8220;The  Arab, Middle Eastern,  Muslim and South Asian communities have  experienced extreme  discrimination in the aftermath of September 11,&#8221;  said Mokhtar  Alkhanshali, a community member and founding member of the  Coalition. &#8220;This Ordinance is a step toward protecting our community  from racial and religious profiling, and requiring transparency and  oversight.&#8221;  San Francisco follows Portland as the second  city in the US <a href="http://r20.rs6.net/tn.jsp?e=001EEc95yrxMB-Xt3SJw3ImIph9vSHqVsLlqSWDYJAGG-lhGUC_9e8sd7Lm9zr1EGo5ab6ZPHqqvb8jWMV5ESuLn32bencq6mHUFQfjKWvBFOKDkIdlTDK7ZY_iGHcBFL2Sd9Cb5Sxwpi4zoO90XFFNfiC31NI-PTRvsB35Wqh2-TqJ6hBvbN6D4jwm3HaAouqrLtS8emS2vgU=" target="_blank">to address its relationship</a> with the FBI&#8217;s Joint  Terrorism Task Force to ensure that state and local standards are  protected.</p>

<p>(SAN FRANCISCO, CA &#8211; 04/11/12)   Yesterday, new legislation was introduced by lead sponsor Supervisor  Jane Kim that is the result of a compromise between community advocates  and the mayor&#8217;s office on the issue of San Francisco Police Department  (SFPD) engagement with the Federal Bureau of Investigation&#8217;s (FBI) Joint  Terrorism Task Force (JTTF).  Last week the board passed the Safe San  Francisco Civil Rights Ordinance for the second time by a vote of 6-5.</p>
<p>&nbsp;</p>
<p>Mayor Ed Lee had threatened to veto the legislation, but after a community campaign aided by the 80 organizations endorsing the Ordinance that  included rallies, letter writing campaigns, calls, and other actions,  the mayor&#8217;s office engaged in negotiations with the Coalition for Safe  San Francisco, resulting in the compromise legislation that was  introduced.</p>
<p>Due  to the community&#8217;s  commitment, pressure, and hard work, Mayor Lee  engaged in negotiations to achieve a compromise,  and the Ordinance was  introduced with eight cosponsors, ensuring a  veto-proof majority!</p>
<p><strong> </strong></p>
<p><strong>The new legislation accomplishes three of the coalition&#8217;s major goals:</strong></p>
<p>&nbsp;</p>
<p>1.      Bringing JTTF activities by SFPD officers under the control of California</p>
<p>constitutional and San Francisco standards;</p>
<p>&nbsp;</p>
<p>2.        Requiring that any new agreements or amendments to agreements be   subject</p>
<p>to public review and discussion before the police commission   before they are</p>
<p>entered into;</p>
<p>&nbsp;</p>
<div>3.      Creating annual reporting requirements on JTTF activities by SFPD officers to</div>
<div>the police commission.</div>
<p>&nbsp;</p>
<p>Mayor Lee stands in support of the community and our concerns through his support of this legislation.  Though   the new compromise legislation is not as specific as the Safe  San   Francisco Civil Rights Ordinance, it does incorporate the Police    Department&#8217;s general orders, and as a result, should have the same    effect.  The lack of specificity will require more careful monitoring on    the part of advocates in working to ensure the new legislation is    implemented as promised.</p>

<p>On Tuesday, April 3rd, the San Francisco Board of Supervisors voted for a second time to approve the <a rel="nofollow" href="http://www.aclunc.org/issues/government_surveillance/in_san_francisco_civil_rights_groups_oppose_secret_agreement_with_fbi.shtml" target="_blank">Safe SF Civil Rights Ordinance</a>.  Introduced by Supervisor Jane Kim in January, the Ordinance has six  sponsors at the Board of Supervisors including Board President David  Chiu. More than 80 legal, civil rights and community organizations have  endorsed this legislation. It provides much needed civil rights  protections around the SFPD&#8217;s collaboration with the FBI, upholding San  Francisco&#8217;s values, protecting California Constitutional rights, and  ensuring police oversight and accountability.</p>

<p>(San  Francisco, CA, 04/01/12) &#8211; On Friday, March 30th, over 300 community  members rallied and prayed in Civic Center Plaza to tell Mayor Ed Lee to  support the Safe San Francisco Civil Rights Ordinance (file #120046).  Despite  repeated requests to listen to community needs, Mayor Lee has not yet  met with the Coalition for a Safe San Francisco which hosted today&#8217;s  rally.</p>

<p>Community disappointed by &#8220;No&#8221; votes from Progressive Supervisors Cohen and Wiener, and look to Mayor Lee for future support</p>
<p></strong><strong> </strong><strong> </strong><strong> </strong></p>
<div style="text-align: left;">(SAN  FRANCISCO, CA &#8211; 03/13/12) Earlier today, the San Francisco Board of  Supervisors voted to pass an Ordinance introduced by Supervisor Jane Kim  titled the Safe San Francisco Civil Rights Ordinance.  The Ordinance  seeks to codify pre-existing San Francisco Police Department (SFPD)  protocol and Department General Orders (DGO) with respect to the SFPD&#8217;s  collaboration with the Federal Bureau of Investigation (FBI).&nbsp;</p>
<p>&nbsp;</p>
<p>The  current agreement with the FBI was signed secretly in 2007 without  public, Board, or Police Commission knowledge.  At present, DGOs and San  Francisco values regarding transparency, accountability, and civil  rights compliance are not mandated, but may be followed simply at the  will of the Officers participating in the FBI Joint Terrorism Task Force  (JTTF).</p>
<p>&nbsp;</p>
<p>This  has been of great concern to City residents who are requesting through  this Ordinance that these laws and values be immediately codified so  that the City is certain to protect against further harassment and  profiling.  In particular those from marginalized and targeted  communities such as the Arab, Muslim, South Asian, Queer, African  American, Chinese, and other immigrant communities are concerned.</p>
<p>&nbsp;</p>
<p>An  Arab community member who was profiled by SFPD and asked to be kept  unnamed for fear of further harassment against him and his family spoke  out saying &#8220;I am in constant fear for my privacy and security.  It is  our hope that this ordinance will protect all of us.&#8221;</p>
<p>&nbsp;</p>
<p>Though  the Ordinance passed today on first vote, with six Supervisors speaking  out strongly in support of the Ordinance, community members were  disappointed by the lack of support from the other Supervisors,  particularly Wiener, Cohen, and Chu who represent communities that are  often victims of FBI or law enforcement harassment.</p>
<p>&nbsp;</p>
<p>Supervisor  Wiener dissented with the Ordinance, stating &#8220;I am 100% supportive of  having those local standards that reflect San Francisco values&#8230; the  question for me is whether this needs to be legislated&#8230; and I don&#8217;t  think it does.&#8221; Although this Ordinance would merely codify the local  standards Supervisor Wiener supports, Wiener exercised his &#8220;no&#8221; vote in  front of dozens of disappointed community members showing that for him  their concerns do not warrant this legislation. Despite hours of prior  community testimony where members of LGBTQ, African American, and  Japanese communities also supported this Ordinance, Supervisor Wiener  dismissed comparisons between law enforcement profiling of LGBTQ and  Japanese communities and the current actions of the FBI against Arab,  Muslim, and South Asian communities.  Other Supervisors voting &#8220;no&#8221;  declined to comment publicly during the vote.</p>
<p>&nbsp;</p>
<p>Board  President David Chiu disagreed with Wiener&#8217;s sentiments and defended  the Ordinance, &#8220;It wasn&#8217;t too long ago that Chinese Americans were  detained and interrogated&#8230; it wasn&#8217;t very long ago that African  Americans had their phones tapped, and that LGBTQ individuals in San  Francisco were dragged from bars and harassed. Every meeting we start  with the Pledge of Allegiance&#8230; we have to do our part to make sure we  stand for a city with &#8216;liberty and justice for all.&#8221;</p>
<p>&nbsp;</p>
<p>Supervisor  Jane Kim thanked the community members and organizations that brought  this forward, and responded to the lone concerns voiced by Supervisor  Wiener, stating &#8220;This ordinance does not make our City less safe, in  fact I would argue that it makes our city more safe by codifying the  civil rights protections we already hold sacred in San Francisco&#8230; If  we really believe in these values then they deserve to be codified into  law.&#8221;</p>

<p>Community  members and representatives of the over 70 endorsing organizations see  today&#8217;s vote as a step in the right direction.  &#8220;Today is a victory in  the initial passage of a law that would help to protect all communities  from racial profiling.  Now we call on the rest of the Supervisors and  the Mayor to stand on the side of justice  &#8211; support this Ordinance and take a proactive stand for civil rights,&#8221;  said Nour Chammas of the Arab Resource and Organizing Center.</p>

<p><strong>Ordinance to Prevent SFPD-FBI Abuse Passes Board of Supervisors with 6 Votes!</strong></p>
<p>&nbsp;</p>
<p><strong>Community disappointed by &#8220;No&#8221; votes from Progressive Supervisors Cohen and Wiener, and look to Mayor Lee for future support</strong></p>
<p>&nbsp;</p>
<p>(SAN FRANCISCO, CA &#8211;  03/13/12) Earlier today, the San Francisco Board of Supervisors voted  to pass an Ordinance introduced by Supervisor Jane Kim titled the Safe  San Francisco Civil Rights Ordinance.  The Ordinance seeks to codify  pre-existing San Francisco Police Department (SFPD) protocol and  Department General Orders (DGO) with respect to the SFPD&#8217;s collaboration  with the Federal Bureau of Investigation (FBI).</p>
<p>&nbsp;</p>
<p>The  current agreement with the FBI was signed secretly in 2007 without  public, Board, or Police Commission knowledge.  At present, DGOs and San  Francisco values regarding transparency, accountability, and civil  rights compliance are not mandated, but may be followed simply at the  will of the Officers participating in the FBI Joint Terrorism Task Force  (JTTF).</p>
<p>&nbsp;</p>
<p>This  has been of great concern to City residents who are requesting through  this Ordinance that these laws and values be immediately codified so  that the City is certain to protect against further harassment and  profiling.  In particular those from marginalized and targeted  communities such as the Arab, Muslim, South Asian, Queer, African  American, Chinese, and other immigrant communities are concerned.</p>
<p>&nbsp;</p>
<p>An  Arab community member who was profiled by SFPD and asked to be kept  unnamed for fear of further harassment against him and his family spoke  out saying &#8220;I am in constant fear for my privacy and security.  It is  our hope that this ordinance will protect all of us.&#8221;</p>
<p>&nbsp;</p>
<p>Though  the Ordinance passed today on first vote, with six Supervisors speaking  out strongly in support of the Ordinance, community members were  disappointed by the lack of support from the other Supervisors,  particularly Wiener, Cohen, and Chu who represent communities that are  often victims of FBI or law enforcement harassment.</p>
<p>&nbsp;</p>
<p>Supervisor  Wiener dissented with the Ordinance, stating &#8220;I am 100% supportive of  having those local standards that reflect San Francisco values&#8230; the  question for me is whether this needs to be legislated&#8230; and I don&#8217;t  think it does.&#8221; Although this Ordinance would merely codify the local  standards Supervisor Wiener supports, Wiener exercised his &#8220;no&#8221; vote in  front of dozens of disappointed community members showing that for him  their concerns do not warrant this legislation. Despite hours of prior  community testimony where members of LGBTQ, African American, and  Japanese communities also supported this Ordinance, Supervisor Wiener  dismissed comparisons between law enforcement profiling of LGBTQ and  Japanese communities and the current actions of the FBI against Arab,  Muslim, and South Asian communities.  Other Supervisors voting &#8220;no&#8221;  declined to comment publicly during the vote.</p>
<p>&nbsp;</p>
<p>Board  President David Chiu disagreed with Wiener&#8217;s sentiments and defended  the Ordinance, &#8220;It wasn&#8217;t too long ago that Chinese Americans were  detained and interrogated&#8230; it wasn&#8217;t very long ago that African  Americans had their phones tapped, and that LGBTQ individuals in San  Francisco were dragged from bars and harassed. Every meeting we start  with the Pledge of Allegiance&#8230; we have to do our part to make sure we  stand for a city with &#8216;liberty and justice for all&#8217;.&#8221;</p>
<p>&nbsp;</p>
<p>Supervisor  Jane Kim thanked the community members and organizations that brought  this forward, and responded to the lone concerns voiced by Supervisor  Wiener, stating &#8220;This ordinance does not make our City less safe, in  fact I would argue that it makes our city more safe by codifying the  civil rights protections we already hold sacred in San Francisco&#8230; If  we really believe in these values then they deserve to be codified into  law.&#8221;</p>
<p>&nbsp;</p>
<p>Community  members and representatives of the over 70 endorsing organizations see  today&#8217;s vote as a step in the right direction.  &#8220;Today is a victory in  the initial passage of a law that would help to protect all communities  from racial profiling.  Now we call on the rest of the Supervisors and  the Mayor to stand on the side of justice &#8211; support this Ordinance and  take a proactive stand for civil rights,&#8221; said Nour Chammas of the Arab  Resource and Organizing Center.</p>

<p>A  proposal to require the San Francisco Police Department to adhere to  local and state privacy laws when they assist in federal  counterterrorism investigations was narrowly approved by the city&#8217;s  Board of Supervisors Tuesday.</p>
<p>The ordinance, which was passed in a  6-5 vote, focuses on how the Police Department collaborates with the  FBI and its local Joint Terrorism Task Force while collecting  intelligence in potential terrorism cases around the region.</p>
<p>Under  a 2007 memorandum of understanding with San Francisco police, the FBI  authorizes a variety of intelligence gathering activities not allowed by  state or city laws, such as the surveillance of someone without any  suspicion of criminal activity.</p>
<p>The legislation passed by the  board Tuesday, authored by Supervisor Jane Kim, would require that San  Francisco police officers follow the local and state laws, and also  would urge the department to amend or terminate the 2007 MOU.</p>
<p>Kim said she believes that officers already follow the local rules but said the policy &#8220;deserves to be codified into law.&#8221;</p>
<p>She  said the idea for the ordinance came after talks with members of the  local Arab and Southeast Asian communities, many of whom came to speak  at an hours-long committee hearing on the issue two weeks ago and  described episodes of racial profiling and discrimination.</p>
<p>Supervisor  John Avalos, who also supported the legislation, said the ordinance was  important because &#8220;public safety is really reliant on sound relations  &#8230; between the community and police.&#8221;</p>
<p>Police spokesman Sgt. Mike  Andraychak said after that committee hearing that the purpose of the  ordinance has already been addressed in an internal department Bureau  Order issued by police Chief Greg Suhr last May shortly after he was  appointed as chief.</p>
<p>Supervisor Scott Wiener echoed that sentiment in his opposition to the proposal.</p>
<p>&#8220;This legislation is not about whether our Police Department should be complying,&#8221; Wiener said. &#8220;Of course they do.&#8221;</p>
<p>He said, &#8220;The question for me is if this needs to be legislated.&#8221;</p>
<p>Board  president David Chiu said the legislation was about &#8220;the legacy we&#8217;re  trying to leave&#8221; by stressing the importance of &#8220;transparency, due  process and our civil liberties.&#8221;</p>
<p>In the end, the board passed the ordinance by a single vote.</p>
<p>Wiener, Malia Cohen, Carmen Chu, Sean Elsbernd and Mark Farrell were the five supervisors to vote against it.</p>
<p>The ordinance will return in front of the board to be finalized next week and then sent to Mayor Ed Lee&#8217;s office to be signed.</p>
<p>Lee  said Tuesday that he would decide on whether to sign the legislation  after discussing it with Suhr, and said he would also like to get the  input of the city&#8217;s Police Commission before making a decision.</p>
